Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Handfelt LLC (“Handfelt,” “we,” “us,” or “our”). They govern your access to and use of our website, our customer portal, and the handwritten-mail services we provide (together, the “Service”). By creating an account, purchasing Credits, sending a campaign, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Refund & Cancellation Policy, each of which is part of this agreement. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms, and “you” refers to that entity.
1. Definitions
“Credits” are the prepaid service units described in Section 5. “Campaign” means a batch of mail pieces you create and submit through the Service. “Recipient” means a person or organization you choose to mail. “Recipient Data” means the names, mailing addresses, email addresses, and other information you upload about your Recipients. “Postage”means amounts charged by the United States Postal Service (“USPS”) to carry your mail. “Subscription” means a paid plan that sets your per-piece pricing and features.
2. Eligibility and accounts
The Service is intended for businesses and organizations, not consumers, and is not directed to anyone under 18. You agree to provide accurate account information, to keep it current, and to keep your login credentials secure. You are responsible for all activity under your account, including activity by your team members. We may refuse, suspend, or close accounts at our discretion, as described in these Terms.
3. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which describes content and conduct that are not permitted (for example, unlawful, deceptive, harassing, or infringing mail). You are responsible for everything you send through the Service and you warrant that your use complies with that policy and with all applicable laws.
4. The Service
Handfelt renders messages in realistic handwriting, prints them on physical mail pieces (such as postcards, letters, flatcards, and notecards), and arranges for them to be mailed through USPS. Features, formats, pricing, and availability may change, and some features may be offered as “beta” or “coming soon” and provided without warranty.
Handwriting is machine-generated.The handwriting we produce is generated by our technology to look natural. It is not the authentic handwriting or signature of any specific individual unless you provide and instruct us to use your own writing sample. You must not use the Service to create documents that require a genuine human signature or that misrepresent who wrote or signed them — for example, checks, contracts intended to bind a signatory by their signature, notarized documents, or government forms. 5. Credits and prepaid balance
You purchase Creditsin advance and spend them on the Service. One Credit is currently worth US$1.00. Credits are prepaid service units — they are not cash, a deposit account, a stored-value account, a gift card, or a general-purpose payment instrument. Credits have no cash value, are non-transferable, and may not be redeemed for cash, withdrawn, sold, or used outside Handfelt. Credits may be used only by the account that purchased them, and they do not expire.
The number of Credits required for a mail piece depends on factors such as your plan tier, format, size, weight, destination, and mail class, plus Postage and any applicable tax. The current price is shown at checkout and at the time you submit a Campaign.
6. Billing and payments
Payments are processed by our payment processor, Stripe. We do not store your full card number. By providing a payment method, you authorize us and Stripe to charge it for the amounts you incur, and you agree to Stripe’s applicable terms.
If you initiate a chargeback or payment dispute, we may reverse the corresponding Credits from your balance, place your account under review, and suspend or terminate it. Repeated or abusive disputes may result in permanent termination. See our Refund & Cancellation Policy for how disputes and clawbacks are handled.
7. Pricing and price lock
Prices are shown at the point of purchase and at the time you submit a Campaign. We may change our prices, tiers, and features at any time, but the price of a Campaign is locked at the moment you submit it. A later change to our rates does not re-price a Campaign you already submitted, and a Campaign you already submitted is not re-priced if you later change your plan tier. Attempts to exploit pricing — for example, upgrading to a lower per-piece tier, sending a Campaign at that rate, then downgrading and requesting a refund of the spent Credits — are not permitted and may result in account review or suspension. 8. Taxes
Our prices are exclusive of tax unless stated otherwise, and you are responsible for any sales, use, or similar taxes on your purchases, other than taxes on our net income. Purchasing Credits is not a taxable event— Credits are stored value, so we do not charge tax when you buy them.
We currently collect sales tax only in Washington State, where we have a tax obligation. Where required, Washington state and local sales tax is calculated when you submit a send, on the taxable portion of your order (including, where applicable, the Postage charged), based on the Washington destination of the mail and the rate published by the Washington Department of Revenue. Subscription invoices billed to a Washington address are likewise taxed. We do not separately charge sales tax for other states. If your organization is tax-exempt, contact us with a valid exemption certificate at support@handfelt.co.
9. Postage and delivery
Postage is separate. Our per-piece price covers paper, print, and envelope; it does not include Postage. Postage is charged in addition, at standard USPS rates, and is subject to USPS rate changes.
We are not the USPS.Handfelt prepares and submits your mail; we are not a mail carrier and we are not an agent of USPS. We do not guarantee any delivery date or that any piece will be delivered. Once mail is tendered to USPS, transit, delivery, loss, damage, and delay are USPS’s responsibility, and any claim for lost or damaged mail must be made with USPS.
Address accuracy is your responsibility. You are responsible for the accuracy, completeness, and legality of every address you provide. We do not guarantee that addresses are valid or deliverable. Mail sent to an inaccurate or undeliverable address, or returned by USPS, is not refundable, and Postage on such mail is still incurred. Unless you instruct us otherwise, returned or undeliverable mail may be securely destroyed.
10. Subscriptions, auto-renewal, and cancellation
Paid Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price, using your payment method on file, until you cancel. You can cancel at any time through the Stripe customer portal (“Manage billing”) in your account; your plan remains active through the end of the period you have already paid for, after which you return to the free Starter plan.
Upgrades take effect immediately and are prorated. Downgrades take effect at the end of the current billing period. Subscription fees are not refundable for the current period. A Subscription does not include Credits — sends are always paid from your prepaid Credit balance, and your plan determines your per-piece price.
11. Refunds
Except as required by law or as expressly stated in our Refund & Cancellation Policy, payments are non-refundable. In summary: unused Credits may be refunded at our discretion to the original payment method; Credits already spent on a send are final; and Subscription fees for the current period are non-refundable. If a defect in a mailed piece is caused by Handfelt (for example, a printing error, a processing error on our part, or a piece we fail to mail), we will reprint the affected pieces or re-credit their cost, at our discretion. 12. Your content and data
You retain all rights in the content you upload — your Recipient Data, message templates, designs, logos, signatures, and writing samples (“Your Content”). You grant Handfelt a limited license to host, process, reproduce, and transmit Your Content as needed to provide the Service, including sharing it with the subprocessors listed on our Subprocessors page.
For Recipient Data, you are the data controller and Handfelt acts as your processor, processing that data only on your instructions to deliver the Service. You represent and warrant that you have all rights, permissions, and lawful bases necessary to upload Recipient Data and to mail to each Recipient, and that doing so complies with applicable law. How we handle this data is described in our Privacy Policy. Note that we use soft-deletion: deleting a list hides it but does not immediately and permanently erase it. 13. Subprocessors
We use third-party vendors (“subprocessors”) to deliver the Service, including a handwriting-rendering service, a print and mail-fulfillment vendor, our payment processor, our email provider, and cloud storage and hosting. The current list and a description of what each accesses is on our Subprocessors page. A data processing agreement (DPA) is available on request at support@handfelt.co.
14. Intellectual property
The Service, including the website, software, models, handwriting technology, curated styles and designs, and the Handfelt name and marks, belongs to Handfelt or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service per these Terms. You may not copy, modify, resell, reverse engineer, or create derivative works from the Service except as permitted by law. Curated handwriting styles and designs remain our property; a style trained from your own writing sample is treated as Your Content, while the underlying models and technology remain ours. Any feedback you provide may be used by us without restriction or obligation to you.
15. Confidentiality
Each party may receive confidential information of the other. The receiving party will use it only to perform under these Terms and will protect it with reasonable care, except where disclosure is required by law or the information is or becomes public through no fault of the receiving party.
16. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that handwriting output will meet your expectations, that mail will be delivered or delivered on time, or that any Campaign will achieve a particular response or result.
17. Limitation of liability
To the fullest extent permitted by law, Handfelt will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or reputational harm, arising out of or relating to the Service, even if advised of the possibility. We are not liable for the acts or omissions of USPS or of other third parties, including our subprocessors, except to the extent the law does not permit such a limitation.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amounts you paid to us in the twelve (12) months before the event giving rise to the claim, or (b) US$100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
18. Indemnification
You will defend, indemnify, and hold harmless Handfelt and its officers, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) Your Content; (b) your Recipient Data or your failure to obtain any required consent to mail your Recipients; (c) your use of the Service in violation of these Terms, the Acceptable Use Policy, or applicable law (including mail, marketing, privacy, sanctions, and consumer-protection laws); and (d) any claim that Your Content infringes or misappropriates a third party’s rights.
19. Dispute resolution; arbitration and class-action waiver
Please read this section carefully — it affects how disputes are resolved and limits your rights.
Informal resolution first. Before starting an arbitration, you agree to send written notice describing the dispute and the relief sought to support@handfelt.co, and to attempt to resolve the dispute informally for 30 days.
Binding arbitration. If the dispute is not resolved, you and Handfelt agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by a recognized arbitration provider under its rules, seated in King County, Washington. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action and jury-trial waivers.Disputes will be arbitrated only on an individual basis. You and Handfelt waive any right to a jury trial and to participate in a class, collective, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of a representative or class proceeding.
Exceptions. Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive or other equitable relief in court to protect its intellectual property or confidential information.
20. Governing law and venue
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. Subject to Section 19, the state and federal courts located in Washington will have exclusive jurisdiction over any matter not subject to arbitration.
21. Force majeure
Neither party is liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, fire, war, civil unrest, labor disputes, governmental action, pandemics, utility or internet failures, and disruptions to USPS or other carriers. Affected obligations are suspended for the duration of the event.
22. Suspension and termination
We may suspend or terminate your access, with or without notice, if you violate these Terms or the Acceptable Use Policy, if your payment fails or is disputed, if we are required to by law, or if we reasonably suspect fraud, abuse, or risk to the Service or others. You may stop using the Service at any time; charges already incurred and your current Subscription period remain payable. If we terminate your account for violation of the Acceptable Use Policy, any remaining Credits are forfeited.Provisions that by their nature should survive (including Sections 5–8, 11, and 14–20) survive termination.
23. Changes to these Terms
We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide reasonable notice (for example, by email or an in-app notice). If you continue to use the Service after changes take effect, you accept the updated Terms.
24. General
These Terms, together with the Privacy Policy, Acceptable Use Policy, Refund & Cancellation Policy, and Subprocessors page, are the entire agreement between you and Handfelt regarding the Service and supersede prior understandings. If any provision is found unenforceable, the rest remains in effect and the provision will be enforced to the maximum extent permitted. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor in connection with a merger, acquisition, or sale of assets. These Terms are in English; any translation is for convenience only.
